GENERAL AGREEMENT

As a participant in the Speak Up for Kids Ambassador Program, I freely provide my professional headshot & bio and authorize Speak Up for Kids to publish this content. I furthermore attest my personal and professional character will uphold the values of Speak Up for Kids and its mission. *

Speak Up For Kids Photography, Video and Biographical Information Release 

I, the listed Volunteer, grant permission to Speak Up For Kids of Palm Beach County, Inc. to use photographs and videos taken of me (and my child, if applicable) and/or my (our) biographical profile and/or story for use in publications such as marketing, direct mail, brochures, newsletters, magazines and all other press and to use the same on displays of any kind, and to use the same in electronic format of any kind, such as the internet, movies, films, television, radio and social media platforms and to offer them for use or distribution in other publications, electronic or otherwise, without notifying me. 

I give permission for photos to be taken of me (and my child, if applicable) on any occasion on the premises of Speak Up For Kids of Palm Beach County, Inc. property or at any functions related to the services of Speak Up For Kids of Palm Beach County, Inc. I waive any right to inspect or approve the finished photographs, videos, profiles, and/or printed or electronic matter that may be used now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the photograph(s) or stories. 

I agree to release, defend, and hold harmless Speak Up For Kids of Palm Beach County, Inc. and its agents or employees, including any firm publishing and/or distributing the finished product in whole or in part, from and against any claims, damages or liability to me, my successors, heirs or assigns, arising from or related to the use of the photographs and videos, including but not limited to any misuse, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in obtaining, processing, or production of the finished product, its publication, or distribution, unless such damage or liability is the result of gross negligence on the part of Speak Up For Kids of Palm Beach County, Inc.. 

I understand that this release pertains to certain important legal rights which I am waiving for me (and my child, if applicable) through the execution of this Release, and that this release applies to all of my successors, heirs, and assigns. I am 18 years of age or older and I am competent to contract in my own name. I have read this release before signing below, and I fully understand the contents, meaning and impact of this release. I have had the opportunity to have this release reviewed by an attorney of my own choice prior to signing. All of my concerns regarding this release have been resolved prior to signing.

Speak Up For Kids Volunteer Release

I, the listed Volunteer, desire to work as a volunteer for Speak Up For Kids of Palm Beach County, Inc. and engage in the activities related to the Ambassador Program. I hereby voluntarily, execute this Volunteer Waiver under the following terms:

I, the Volunteer, release and hold harmless the Speak Up For Kids of Palm Beach County, Inc. and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with the Speak Up For Kids of Palm Beach County, Inc..

I understand that this Waiver discharges Speak Up For Kids of Palm Beach County, Inc. from any liability or claim that I, the Volunteer, may have against Speak Up For Kids of Palm Beach County, Inc. with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation on the Speak Up For Kids of Palm Beach County, Inc. work site. I also fully understand that Speak Up For Kids of Palm Beach County, Inc. does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.

I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of Speak Up For Kids of Palm Beach County, Inc. beyond what may be offered freely by the representative of the Speak Up For Kids of Palm Beach County, Inc. in the event of such injury or medical expense.

I hereby release Speak Up For Kids of Palm Beach County, Inc. from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency during my time with Speak Up For Kids of Palm Beach County, Inc..

I grant unto Speak Up For Kids of Palm Beach County, Inc. all right, title, and interest in any and all photographic images and video or audio recordings that are made by the Organization during my work with the Organization, including, but not limited to, any royalties, proceeds, or other benefits that are derived from such photographs or recordings.

I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Florida in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of Florida. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
